TPD Vaping Laws UK – 2017 Regulations

tpd 2017In May 2017 the Tobacco Products Directive will come into force. This regulation was created in the EU parliament by un-elected officials, voted through by MEP’s and coincided with a massive increase in lobbying spend by tobacco and pharmaceutical industries. However as this was enacted into UK law in May 2016 the recent Brexit vote to leave the EU will not effect this current legislation, only a repeal of the law in UK parliament would change the current situation.

This is an update to the article: “Electronic Cigarettes in 2016 – How E-cig UK regulation is set to change the way you vape” which received hundreds of thousands of views and hundreds of comments and shares.

To recap, here are some of the regulations and restrictions that must be complied with for the e cigarette regulation for 2017.

UK Vaping Laws 2017

Maximum refill containers can not exceed 10ml.
Aside from the increase of environmental waste from all these extra plastic bottles, this will increase e liquid cost as packaging makes up a significant part of the cost of production.

Maximum nicotine strength of 20mg.
A blow to new users who are coming from a heavy smoking habit, 24mg was a common strength to help initially kick the cigarettes. The biggest effect will be on the DIY market, where high strength nicotine concentrate of up to 72mg/L was commonly used to mix your own juice. No “end consumer” can purchase nicotine base liquid in strength over 20mg/L and bottle size over 10ml.

Maximum tank capacity of 2ml.
Say goodbye to a lot of the high performance and “sub ohm” vaping tanks and a massive reduction of product choice. Expect only a few compliant tanks to be available and to be refilling them much more often.

Product approvals, Packaging requirements, customer notifications and data reporting.

Some of this is welcomed by the industry to increase quality control and safety, however much of this is already done voluntarily by reputable retailers and manufacturers. Costly product registration for each and every product variation (each variation of strength and flavour) will massively reduce e liquid choice and new flavours brought to market. Extra business costs for compliance will ultimately lead to increased cost of products for the consumer.

Expect a massive shake up of the industry with smaller businesses shutting down, a massive reduction of product offerings and increased costs across the board.       I fully agree with this but you said it yourself in the post, tobacco industries are losing so much revenue from the vaping industry that the collapse of tobacco would destroy other industries like the cancer research, cancer research and the tobacco companies earn the same money, people buy tobacco which goes into all these new lukemia equipment, and the money people spend to use these machines goes into the tobacco branding fund, so they can grow and sell more tobacco, the amount of money the tobacco industry and other industries would lose if they collapsed would be tremendous, furthermore the TPD bought the rights to all vaping regulations so that they can control what happens with vaping, if vaping gets crazy they up the price then when tobacco starts kicking off again they’ll up the prices, it’s an endless cycle that will just end up flowing their pockets with more money and so forth with these other industries with shares in the products.

          What he means is that they do give funding which is true, they don’t pay for the whole thing just a certain percentage of their profits go to funding.

          But where he is wrong is that if every person stopped then the risk of lung cancer to people is less, even though cancer research will get less funding it will balance itself out as less and less people will be treated for cancer.

          As for these silly little laws from the TDP I can’t see the difference between buying a 10ml bottle to buying 10 x 10ml bottles which would still add up to 100ml also buying a tank that hold 2ml to filling up that same tank 3 times, if they are talking about the amount of vape they produce then they need to look at the coils not the tanks, a 2ml tank can produce the same and even more vape than a 6ml tank depending on what tank and coil setup you use.

          I think these laws are strictly money based to make people pay more it has nothing to do with encouraging kids to vape as it was once stated or for the health reasons as its been proven time and time again its a lot safer than a real cigarette.

          Kids will Vape or smoke a real cigarette they don’t need to be encouraged to do this, if they want to do it they will no matter on what the health risk is or the cost.

The astounding degree of ignorance the law makers are showing just makes me want to knock their heads together.       the is no law stating that you can’t buy bigger tanks from over seas the law ism just for shops in this country.

      They can still sell the coils just not the tanks which to me is stupid because the GMT will lose revenue, me personally would not limit the size of tank you can use because the bigger that tank is the bigger the coils is going to be and the bigger the coil the more juice is used per toke which inturn means your going to buy more juice which means more revenue.

    All of you should quit vaping. I vaped for 2 months to get off cigarettes and then off vaping. I am appreciative to the help vaping provided me. But by remaining an addict to nicotine, I end up paying whatever is the going rate for my nicotine, no thankyou. What do you all expect the government not to tax vaping. It was always going to happen.

Yeah some people use vape as a method to come off cigarettes but others actually enjoy it as much as your general working man or woman who hoes to the pub to enjoy a drink. You can get 0mg nicotine flavours. I know people who vape and have never touched a cigarette in their life. I enjoy vaping. I find it pleasant and it doesn’t make my clothes stink and doesn’t discolour my skin. Fuck the vape haters . They should go find something else to moan about and leave vapours alone.

Why the hill billy fuck do you do that when a sub ohm vaper needs more than a 10ml bottle. You can’t give somebody a gift & then they really enjoy it & works just fine… But wait, I’m taking that gift back from you, adjusting it & you won’t like it as much.     Vaping is dying now! I was a smoker for 16 years. Cigarettes and a Pipe. Switched to Vaping 2 years ago.

    Currently Vaping 18mg juices Sub Ohm (Kangertech SubTank Plus) also just bought a SMOK TFV8 on Wismec 200W mod.

    What a waste of money! Come May, coils will be unavailable I can’t build my own. So screwed.

    I’ve worked out that the new regulations will cost average Vapers the same as 20 cigarettes a day buying mid range cigarettes like Mayfair or L&B!

    That is secretly I think what EU hope we do. To add insult to injury Zamplebox monthly subscription service based in USA but delivers worldwide have discontinued the 18mg strength!

    They cannot tax vape liquids as it may contain nicotine but it contains PG as usually 50% of the mixture this ingredient is also found in sabutol inhalers and as a free presribed medicine cannot tax, if they taxed liquid the would have to start charging children with asthma for there medicine

    There needs to be a wider educationon on vaping with the public being given the TRUE facts about the BENEFITS of Vaping.
    The government will get away with heavy taxation and changes with the majority of the public backing there decision due to
    the large amount of b/s and old wives tales regarding vaping

    I tried e cigs when they first came out and was not impressed. Have also tried every way imaginable to get off a 25 year smoking habit
    that at the peak of it i was smoking 120 a day. After cutting down to 40 a day i then tried vaping ( which i had in the past thought was a wankers sport )

    Since Starting Vaping i have not bought a packet of cigarettes or had a cigarette in 3 weeks ( so much for a wankers sport ).
    I wish i had started Vaping sooner but was put off by all the b/s and public perception about it.
    To name a few of the immediate benefits, I have never felt better, smell better, have more money and have a greater lifespan ahead of me.

    Many things i encounter in my ( and your ) daily life have a much higher risk to health from inhalation etc yet these have largely been taxed to death
    already and remain off the flogging post radar.

    Bottom line. Vaping saves ! As proven by a recent Cancer research uk investigation that proved that vaping gives 97% LES TOXINS THAN A REGULAR CIGARETTE!

    The simple reality is that there are two groups that make a lot of money out of smoking and that one is the tobacco companies, and the other is the government, which in the UK at least is the biggest financial beneficiary by a very large margin. .

    For years there has been a polite fiction that smoking needs to be taxed heavily because of the extra medical costs caused by smoking, but the truth is that these are far more than outweighed by the savings in care and pension costs delivered from smokers dying earlier. If it was about fiscal reality the government would have been subsidising smoking rather than taxing it all these years.

    The important addicts here are these two groups, who are facing a possible wipeout of tobacco smoking within a few years in the western democracies if vaping isn’t restricted. They are taking steps to slow the conversion from smoking to vaping to protect their revenues (and in the case of government, minimise their additional expenses) as long as they can.

    It is very well demonstrated to everyone that the vast majority and possibly all of the health problems from smoking comes from burning and inhaling tobacco. That is not a factor at all in vaping, which as yet has no demonstrated long term ill effects, and is extremely unlikely to have any ill effects comparable to tobacco smoking. It is sadly ironic that governments are trying to restrict this innovation that has given the opportunity to entirely eradicate the massive killer that is tobacco smoking over the next decade or two.

    Nicotine is addictive, but unless a massive dose is taken has no demonstrated ill effects and arguably has beneficial effects in terms of mental acuity among other things.

    As ever this is all about money, and reveals the hollowness of the political concerns about public health that have been used for many years to turn smoking into a huge cash cow for governments.

    I used to love this country but I’m afraid it is getting steadily more broken by the day. There is no reason for most of the tpd nonsense other than to throttle back a growth industry while tobacco and pharmaceutical faucets figure out how to get in on the action.
    We voted to leave the EU, now we are expected to sit back while they serve us up a large portion of shit for at least the next couple of years, in all reality it will be longer. As usual the brits will just sit back and take it like children, afraid to stand up or say anything. Makes me sad, and mad in equal measure.

    Ah well it had to happen eventually. Tobacco Companies just had to retaliate against Vaping because of their losses of revenues. So what do they do? and how much do they spend in lobbying Governments to introduce absolutely stupid laws that hit the reforming smokers? My own experience of vaping has been within 3 days I kicked the habit of 40 cigs a day, and that was 5 yrs ago, I had been a heavy smoker for around 50yrs or so, since then I once bought a pack of 10 cigs and ended up throwing 7 of these away, and now maybe I’ll smoke 1 or 2 cigs a month.

    There will obviously be a strong Black Market in Vaping products and no doubt this will increase the interest of the criminal fraternity with all the consequences involved, even maybe the Police breaking down doors in the search for vaping products, eventually, and Vaping Squads roaming the streets, hacking our computers and listening into our mobile phones.trying to catch us vaping….George Orwell certainly had the correct visions of the future!!

    I just come back form 2 weeks in Spain and I never saw a local person using an e cig. Trying to buy Liquid was a no no. I did ask in a tobacco shops but they told me that fags & tobacco is still quite cheep so no one uses an e cig.

    I think a bit of legislation around the standard of content of juice is a positive step and the max 20 mg strength will only affect a few. But anyone who thinks:
    a) A 2ml tank will do anything other than make us top up more often
    b) 10ml bottles of juice will do anything other than increase cost and the number of discarded plastic bottles
    c) Nicotine concentrate is more harmful than bleach (both have childproof tops)
    d) A consistent dose of nicotine can be achieved when you can take a small drew or a big draw (this is not even a part of cigarette legislation)
    e) Leak free refilling can be achieved when the user has to point the nozzle in the right direction
    f) strangling the ecig industry will help people give up smoking

    clearly is totally ignorant about vaping and totally stupid for not researching the subject before introducing ridiculous legislation. Well done EU, you have once again excelled in your stupidity. The sooner we can revise this legislation in UK law and bring some common sense into play the better. In the mean time I will buy my nicotine concentrate (I mix my own juice) from anywhere I can – probably where it is less regulated than at present!!

    1) we are still part of the EU
    2) even if once we leave the EU our government is not going to change a law that benefits them financially unless it is to make it more financially beneficial for them.     As a heavy smoker of 25 or more a day, at the age of 35 I picked up an e-cig. I’m proud to say a cigarette has not passed my lips since. I had been smoking this amount for 20yrs. I wish I knew more about buying abroad & making my own as I have read on these comments. This is the first ever post I have been compelled to write. I have only just heard about the law when I recently ran into trouble buying my usual brand. Apparently they are no longer buying in advance of the new laws coming in. I agree, I voted out, I expected out. We are called Great Britain for a reason, it’s a shame only our people believe that and not our government. I believe I am saving the NHS money on my future healthcare costs, So why should I be taxed further? If crack cocaine, heroin, cannabis and other drugs be legalised, surely they should tax those first and make our country a safer one by reducing the crime these ‘true’ drug addicts cause and reduce policing costs. Leave us to vape in peace, we harm no one. Chav or not, I’m living in what is supposed to be a ‘free’ country, yet. I am restricted on my pleasure 🤔

    Seems no one gives a shit about the environmental impact this will have… How much extra plastic and paper is needed to produce only 10ml bottles! I buy in 100ml only so now will have ten empty plastic bottles instead of one, plus the extra labeling needed. So wrong!!
